Prohibition — Judges — Disqualification. In a proceeding in the Supreme Court, where an alternative writ had been directed to a district judge restraining him from proceeding in a case and where such judge filed in the Supreme Court a certified copy of an admission that a timely affidavit of disqualification had been filed against him, the alternative writ was dissolved and the district court was directed to secure another judge and proceed to the determination of the matters at issue. 2. Prohibition — Damages and attorneys fees. Where the petition to prohibit a judge from hearing and deciding demurrers in an action pending before him did not claim damages or attorneys fees, the right to recover them was waived.
